The myth or reality (?) of Truth and Reconciliation Commission (TRC) and Committee on Enforce Disappearance (CED) brought civil society organizations, human rights defenders, advocates and conflict victims together to express their gross concern over controversial provisions in TRC-Act in a UPR consultation meeting at Capital Kathmandu.
The Act was passed in parliament by the support from major political party’s whip to favor in April 2014 that provides power to grant amnesty even to those who are involved in crime under international law. Act also prohibits legal action in mediated cases, do not recognize the rights of reparation and promote reconciliation on serious human rights violations. Despite the appeal from common platform of victims, president approved the Act in May 2014.
The Act also has ruled out a verdict of Supreme Court of Nepal and being criticized by UN High Commissioner for human rights for breaching international law.
What might come up in upcoming UN-UPR, after all though Human Rights Council (HRC) is an informal system where everyone can involve directly or indirectly that makes it effective however itself a political mechanism where international role may depends upon power relation between nations- said Mr. Rabindra Bhattarai; a Nepali advocate.
Officials from peace and reconciliation ministry remained absence in consultation meeting expressing their oblivious to what UPR is all about.
On January 12, Recommendation Committee which is responsible for nominating chairs and commissioners for TRC announced list roster of candidate for public opinion. People can file via District Peace Committees or District Administration Office (DAO) in ten days.
Practically most of the victim resides in remote areas that don’t have access of information in such case. Filing complain against candidates is not possible, and this announcement was done intentionally amidst of current tension of constitution assembly- said Mr. Suman Adhikari; a conflict victim.
“We had very high expectation when Comprehensive Peace Accord (CPA) was signed in 2006, ever since lobby was started for TRC but many things are being covered”- He argued.
A source claimed that, political parties have already proposed their close candidate for chairmanship and commission members who will likely to be endorse finally.
Mr. Pradip Pokhrel; a member of committee, said that it is hard to find non political figure for civil concerns, every-body are openly affiliated to political parties-TRC is influenced by those political figures.
According to him, people deprived from social and economic rights gave birth of conflict in remote most areas.
Last UPR created serious question mark over impunity in Nepal while powerful perpetrator still openly claims their deeds but legal system is unable to bring them in to justice.
Relief package; the government provides, are being mostly captured by fake victims on the base of their political influence in the districts. A woman from village shares that she still can’t forget how she was sexually treated, eyes of a daughter whose father is still disappeared are not dried yet, neither a destroyed family members received reparation. Let there not be miscarriage of justice, let the impunity do not rule over human right.
